Terms & Conditions

O’Connor Outdoor Living

These Terms & Conditions govern the purchase of products and services provided by O’Connor Outdoor Living (“Company,” “we,” “us,” or “our”). By engaging our services or purchasing products, you agree to the following terms.


1. Scope of Services

All services are provided as outlined in the written estimate, proposal, invoice, or service agreement issued by O’Connor Outdoor Living. The specific terms of each project, including scope, materials, warranty, timeline, and pricing, will be defined in the applicable contract.

If a written contract exists, the contract terms oversee general terms on website.


2. Payment Terms

Online Purchases

Products purchased through our website or online platform are due in full at the time of purchase unless otherwise stated.

Orders will not be processed until payment has been received.


Contracted Services

For installation, design, or service projects, payment terms are governed by the signed project agreement.

Typical payment structures may include:

  • Deposit upon acceptance
     
  • Progress payments
     
  • Final payment upon substantial completion
     

Failure to make payments as outlined in the contract may result in suspension of work until account status is resolved.


3. Changes & Additional Work

Any changes to the original scope of work must be approved in writing. Additional work requested by the client may result in additional charges and may affect project timelines.


4. Scheduling & Delays

Project timelines are estimates and may be affected by:

  • Weather conditions
     
  • Material availability
     
  • Site conditions
     
  • Permit or inspection delays
     
  • Events beyond our (O'Connor's Outdoor Living, LLC) reasonable control
     

O’Connor Outdoor Living will communicate delays as reasonably practicable.


5. Cancellations

Online product orders may be canceled prior to shipment. Custom-fabricated or special-order items are non-cancelable and non-refundable once production has begun.

Contracted services may be subject to cancellation terms outlined in the project agreement.

Deposits may be non-refundable as specified in the contract.


6. Warranty

Warranty coverage is governed by our published Warranty & Return Policy and any specific warranty terms outlined in the project agreement.

Manufacturer warranties apply to applicable components and products.


7. Limitation of Liability

O’Connor Outdoor Living shall not be liable for indirect, incidental, or consequential damages arising from the use of our products or services.

Our liability shall not exceed the total amount paid under the applicable contract or purchase.


8. Governing Law

These Terms & Conditions are governed by the laws of the State of Oregon.


9. Modifications

We reserve the right to update or modify these Terms & Conditions at any time. Updates will be posted on our website with a revised effective date.

At O’Connor Outdoor Living, we stand behind the quality of our craftsmanship and materials. The following policy outlines our warranty coverage and return terms.


1. Plant Material Warranty

Plant material installed and professionally maintained by O’Connor Outdoor Living is eligible for a conditional lifetime workmanship and care warranty, structured as follows:

  • Annual Maintenance Plan: 1-Year / Season Plant Warranty
     
  • Bi-Annual Maintenance Plan: 2-Year Plant Warranty


  • Perennial (Woody & Herbaceous) -- Most plants land in this category. However, plants from other climates may not respond the same when planted in the Pacific Northwest.
     
  • Ongoing Maintenance Plan: Warranty extends annually while maintenance remains active and in good standing .
     

This warranty applies only to plant material installed by O’Connor Outdoor Living, LLC and maintained under a full service landscape maintenance active service agreement.


Exclusions:

This warranty does not cover damage caused by: The warranty follows the plants life biology, non-approved sprinkler system, Extreme weather or acts of nature (including but not limited to extreme weather, drought, flood, freeze, wind, fire), Vandalism or physical damage, Insect infestations or rodent damage, Animal browsing or wildlife activity, Lack of proper irrigation or irrigation system failure, Changes in site conditions, soil conditions, or drainage, Damage caused by third parties or other contractors.)


*O'Connor's Outdoor Living reserves the right to accept or deny all warranty claims.


 

2. Irrigation & Underground Utilities Warranty

All irrigation wiring and underground piping installed by O’Connor Outdoor Living are covered by a lifetime workmanship warranty. All other parts to the irrigation system are covered by the manufacturer warranty.  Labor warranty is charged for replacement of manufacturer warranties at the regular labor price per hour during the time that the work is required.


Exclusions:

This warranty does not cover:

  • Damage caused by excavation by others
     
  • Utility strikes
     
  • Root intrusion
     
  • Ground shifting beyond reasonable conditions
     
  • Acts of nature or vandalism
     

*O'Connor's Outdoor Living reserves the right to accept or deny all warranty claims.



3. Hardscape, Concrete & Custom Features

Custom fire features, water bowls, benches, and concrete elements are covered by a workmanship warranty as outlined in the project agreement.

Manufacturer warranties apply to components such as burners, pumps, lighting fixtures, and electrical systems.

If a manufacturer-covered item requires replacement:

  • The client will be responsible for labor costs associated with removal and reinstallation.
     
  • Warranty claims must follow manufacturer procedures.


  • Custom concrete fixtures have a warranty from cracking or breaking for 1 years from installation by O’Connor's Outdoor Living,  LLC when the site is maintained  by O’Connor's Outdoor Living,  LLC with the potential for renewing the warranty annually for the life of the product. This warranty may be extended at the end of the term at O'Connor's Outdoor Living,  LLC discretion. Non monthly maintenance properties will receive a 90 day warranty or the manufacturer if less  time on products.


*O'Connor's Outdoor Living reserves the right to accept or deny all warranty claims.


 

4. Product Returns (Retail or Stand-Alone Sales)

If O’Connor Outdoor Living offers retail or stand-alone product sales:

  • Returns must be requested within 14 days of purchase.
     
  • Items must be unused and in original condition.
     
  • Special-order or custom-fabricated items are non-refundable.
     
  • Refunds will be processed using the original payment method within 10 business days of approval.
